3, 2, 1, GO! ~ Not so fast! Nintendo Co. has filed suit against go-cart company MariCar, claiming violation of copyright.

Nintendo alleges that Nintendo game characters and pictures are being used to promote the Tokyo-based company. The costumes are rented to MariCar customers for their ride around the metropolis.

The use of Nintendo’s intellectual property is also unfair competition, according to the game giant.

MariCar’s name is also in question, as it could be seen as an abbreviation of “Mario Cart.”

Nintendo seeks 10 million yen for damages after issuing warnings to MariCar over the past few months.
